A traffic collision report was completed by California Highway Patrol, which determined that the other driver caused the collision in violation of California Vehicle Code (CVC) section 22350, which states – “No person shall drive a vehicle upon a highway at speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” Months following the collision, our client noticed that a previously implanted spinal cord stimulator in her back was malfunctioning. Our client presented to her physician with complaints of persistent pain in her lower back that radiated to her left buttock and left leg, associated with a numbness and tingling sensation. She stated that her spinal cord stimulator was not working properly and malfunctioning since the collision. On examination, she had an antalgic gait, tenderness over her lower back, and a palpable implantable pulse generator (IPG) in her left flank. Ultimately, many months after the collision, our client’s previously implanted spinal cord stimulator was surgically replaced. This case was litigated, and attorneys for the other driver argued that our client’s spinal cord stimulator malfunctioned on its own and without any influence from the motor vehicle collision. We consulted with a medical device expert who opined that the forces from the collision likely interfered with the proper functioning of the stimulator. With the information provided by our expert, we negotiated an over-quarter-million-dollar settlement for our client.

Auto Accident – Our client, a 37-year-old male, was driving a small pickup that had proceeded through an intersection on a green light.
